Promising football exoneree wastes no more time

The California Innocence Project worked to free Brian Banks after spending 9 years in prison while being innocent of his charges of rape. Their ability to do this was largely due to his alleged victim’s confession that he did not rape her. Wanetta Gibson changed an instance of “making out” in an indiscreet location on school grounds into charges of rape and a $1.5 million lawsuit against the school district for a lack of consideration in assuring her safety.

Articles on Banks’ exoneration do not suggest whether the then expected-to-be football star would press charges, using the grounds he certainly has. Like many other exonerees, he does not want to waste time and effort seeking revenge against his wrongdoers but rather embark again upon his passion. Banks may seek rightful compensation from the State for his wrongful time served.

One of the biggest question is what may happen to Gibson and the $1.5 million she received. Could she face civil or criminal prosecution for basing her lawsuit on false claims? And what about the money? Common sense says it should be returned. But what if she can’t repay it?
